DEFINITION AND PRINCIPLES OF VOLUNTEERING

Definition of Formal Volunteering 
Formal volunteering is an activity which takes place in not-for-profit organisations or projects and is undertaken:

  • To be of benefit to the community and the volunteer; 
  • Of the volunteer's own free will and without coercion; 
  • For no financial payment;
  • In designated volunteer positions only.
Principles of Volunteering 
 
  • Volunteering benefits the community and the volunteer. 
  • Volunteer work is unpaid.  
  • Volunteering is always a matter of choice. 
  • Volunteering is not compulsorily undertaken  to receive pensions or government allowances. 
  • Volunteering is a legitimate way in which  citizens can participate in the activities of  their community. 
  • Volunteering is a vehicle for individuals or  groups to address human, environmental and  social needs. 
  • Volunteering is an activity performed in the  not-for-profit sector only. 
  • Volunteering is not a substitute for paid work. 
  • Volunteers do not replace paid workers nor  constitute a threat to the job security of paid  workers. 
  • Volunteering respects the rights, dignity and  culture of others. 
  • Volunteering promotes human rights and  equality. 
CHECKLIST FOR VOLUNTEERS
  
Check that:
 
  • The organization is a not-for-profit
  • The purpose of the organisation matches your own values and beliefs
  • The organisation carries volunteer insurance
  • Your role is clear and specific
  • The organisation can provide you with written information about its purpose and activities
  • You are satisfied that the funds of the organisation are expended in accordance with its mission.

The privacy of your personal information is very important to us. In order for us to gain and maintain your continued support, we operate under a code of conduct, set out below. 

By registering with us, you consent to our use of your personal information in accordance with this Privacy Statement. Any terms which are defined in the Volunteer Terms and Conditions of Use, which may be accessed by clicking here, have the same meaning in this Privacy Policy. 

Why Do I Need To Supply Personal Information?
We require your personal information so that we can efficiently facilitate the matching of volunteer opportunities between you and not-for-profit organisations. We also require personal information to improve the services we provide to support not-for-profit organisations. 
 
When Is My Personal Information Collected?
We collect your personal information when you register on the site, or when you supply any information to us by responding to a volunteer opportunity. In addition, we collect information when you correspond with us or use the Site to make enquires. 

Our server may also automatically collect 'additional information' about your use of our service. This information can be described as navigational data and comprises: browser type; IP address; the URL you come from and go to; links to other websites you click on; the pages you view on our Site and time spent on it; cookies; your domain type and service provider. It is standard for many websites to collect this type of information in order to enable them to monitor usage of a website and improve website content and navigation. 

We also collect navigational data by placing cookies in your browser file on your hard drive. Cookies do not capture or track any personal information and cannot identify you as an individual. If you wish, you may elect to not accept cookies on your browser. This should not adversely affect your experience when visiting the Site.

Where Will My Personal Information Be Used?
We will use the navigational data and information that we collect about your use of the Site by combining this with information we collect about other users to give us aggregated results (i.e. results which do not identify any individual) about the usage of the Site. We do this to monitor Site usage, to improve the look, content and navigation of the Site and to improve the services we provide for not-for-profit organisations. 

In order to improve our service we may use your personal information, such as your e-mail address, to request comments about your use of our Site. If you choose, you can opt-out of receiving such communications from us by visiting the opt-out section, and following the instructions to unsubscribe. 
 

Will My Personal Information Be Given To Anyone Else?
We may give any personal information that you provide to us in relation to a particular volunteer opportunity to the relevant not-for-profit organisation. Where you have registered with the Site and provided personal information to us, we may also provide this information to the relevant not-for-profit organisation when you respond to a particular volunteer opportunity. 

We may also disclose your personal information to third parties where it is  required by law, such as for law enforcement purposes or where there is a threat to a person's safety. 

Our Site may from time to time contain links to other websites. We stress that these websites may have a different privacy policy to ours, and you should check this with them. 

How Do We Keep Your Personal Information Safe?
All transmission of personal information is protected between your browser and our Internet server. You will know when transmitted data is safe by a security notice when you enter a secure page, and by the presence of an icon on your browser, either a key for Netscape or a lock for Microsoft Internet Explorer. Additionally, secure web pages can be identified by the URL. A standard page will begin with 'http://' where as a secure web page will begin with 'https://'. The pages where you submit your personal information are all covered by these  security measures. 

Personal information received from you is stored on our servers. Our servers cannot be accessed by any person who is not authorised by us. 

Can I Correct Or Update My Personal Information?

Once you have registered with us, you may at any time access and modify the personal information you provided in the registration form by visiting our profile update page. If your information is incorrect or out of date we ask that you correct that information. 

We will also take reasonable steps to destroy or permanently de-identify personal information if it is no longer required. Information is never completely destroyed due to technical and accounting constraints, plus legal responsibilities that require us to retain some information.

How Will This Privacy Statement Be Updated?
We strive to comply with the Privacy Commissioner's Information Privacy Principles in the National Scheme for Fair Information Practices in the Private Sector. We also intend to comply with industry privacy codes as and when they are developed.  

If further privacy legislation and/or self-regulatory codes are introduced or our  Privacy Statement is updated, we will summarise any modifications or enhancements in this section of our Privacy Statement. 

VOLUNTEER RIGHTS 
 

Unlike paid staff, volunteer staff are not covered by award conditions or work place agreements. Volunteers, however, do have rights, some of which are enshrined in legislation and some of which are the moral obligations of an organisation involving volunteers. The following list is the basis of your rights as a volunteer. As a volunteer you have the right: 
 
  • To work in a healthy and safe environment  (refer Occupational Health and Safety Act[s]); 
  • To be interviewed and employed in  accordance with equal opportunity and anti- discrimination legislation; 
  • To be adequately covered by insurance; 
  • To be given accurate and truthful information about the organisation for which you are working;
  • To be reimbursed for out of pocket expenses incurred on behalf of the organisation for which you are working;
  • To be given a copy of the organisation's volunteer policy and any other policy that affects your work; 
  • Not to fill a position previously held by a paid worker; 
  • Not to do the work of paid staff during industrial disputes; 
  • To have a job description and agreed working hours; 
  • To have access to a grievance procedure; 
  • To be provided with orientation to the organisation; 
  • To have your confidential and personal information dealt with in accordance with the principles of the Privacy Act 1988; and 
  • To be provided with sufficient training for you to do your job.
VOLUNTEER TERMS AND CONDITIONS OF USE

1. These Terms And Conditions 
(a) Please read these terms and conditions carefully as they apply to your use of this Internet website (Site). By using this Site you agree to be bound by these terms and conditions.
 
(b) We may revise these terms and conditions from time to time by updating this posting. The revised terms will take effect when they are posted. 
 
2. Operation of Site 
(a) The Site enables volunteers such as yourself to access volunteer opportunities. These volunteer opportunities will be posted electronically on the Site by not-for-profit organisations. Where you provide us with information in relation to a particular volunteer opportunity, we will endeavour to provide that information to the relevant not-for-profit organisation. The Site may also include other information of a general nature, links to other websites and information. 
 
(b) While we technically operate the Site we exercise no editorial control over much of the Content on the Site, and in most cases the Content on the Site is provided by other persons, such as not-for-profit organisations and other third parties (Third Party Content). 
 
(c) The Site only seeks to match your interests in pursuing volunteering with similar opportunities to participate in volunteering activities offered by not-for-profit organisations. Where such similarities exist we will provide the information you Post on the Site to one or more not-for-profit organisations. Those organisations will then contact you directly and it is the responsibility of you and the not-for-profit organisation to determine whether you both wish to pursue the volunteering opportunity. 
 
(d) Your correspondence or dealings with any not-for-profit organisation or any other third parties are solely between you and those not-for-profit organisations or third parties. We are making no recommendation in relation to the appropriateness of any volunteering opportunity. We do not contract with you and are not responsible in any way for any legal or other requirements relating to any volunteering opportunity. You agree that we will not be liable or responsible for any loss or damage of any sort incurred as the result of your dealings with a not-for-profit organisation. 
 
(e) We do not monitor or exercise editorial control over Third Party Content, however we reserve the right at our discretion to: 
 
(i) access or examine any Third Party Content;
(ii) refuse to provide any Content provided by you to not-for-profit organisations (regardless of whether you were responding to a particular volunteer opportunity); and 
(iii) move, remove or disable access to Third Party Content which we consider, in our sole opinion, to breach any Applicable Law or to be otherwise unacceptable. 

3. Your Use of the Site 
(a) You must not post any content that: 
 
(i) you do not have the right to Post;
(ii) is defamatory or in contempt of any legal or other proceedings; 
(iii) is misleading or deceptive;
(iv) incites hatred or discrimination against any group of persons being a group defined  by reference to colour, race, sex, origin,  nationality or ethnic or national origins;
(v) denounces religious or political beliefs; 
(vi) includes religious or political material  which is or is likely to be offensive; 
(vii) is indecent, obscene, vulgar,  pornographic, offensive or of doubtful  propriety or of a menacing character or is  likely to annoy or concern; 
(viii) infringes any copyright, trade mark,  patent or other intellectual property right of  another person; 
(ix) contains any unsolicited or unauthorised  advertising or promotional material;
(x) contains viruses or similar software or  data which is designed to interrupt, destroy  or limit the functionality of any computer  software or hardware; or 
(xi) impersonates any person or  misrepresents your relationship with any  person. 

(b) You must not:
 
(i) disrupt or interfere with the Site or servers  or other software, hardware or equipment  connected to or via the Site; 
(ii) violate any Applicable Law relating to your  use of the Site; or 
(iii) collect or store personal data about other  users of the Site. 

4. Intellectual Property Rights 
(a) You acknowledge that Content on the Site is subject to copyright and possibly other intellectual property rights (Intellectual Property Rights). 

(b) Unless you are expressly authorised by law you must not yourself, or participate in or permit any other person, to:

(i) sell, reproduce, distribute, modify, display, publicly perform, prepare derivative works based on, repost or otherwise use any of the Content in any way for any public or commercial purpose without our prior written consent; 
(ii) use any Content on any other web site or in a networked computer environment for any purpose; or
(iii) otherwise infringe the Intellectual Property Rights of any person in using the  Site or any Content. 

(c) Nothing you do on or in relation to the Site will transfer any Intellectual Property Rights to you or licence you to exercise any Intellectual Property Rights unless this is expressly stated. 
 
(d) In relation to any Content Posted by you, but subject to our privacy policy discussed below, you grant us a perpetual, irrevocable, royalty-free licence to use that content for the purposes for which the Site exists.

(a) We have not reviewed all of the sites linked to this Site and are not responsible for the content or accuracy of any off-site pages or any other sites linked to this Site (including without limitation sites linked through  advertisements). (a) In using the Site you may give us personal information. Our privacy policy is  available and can be viewed on this site. 

7. Use of the Site is at Your Risk

(d) If any part of this agreement is held to be unenforceable, the unenforceable part shall be given effect to the greatest extent possible and the remainder will remain in full force and effect. 
 
(e) This agreement will be governed by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales, Australia. 
 
(f) You agree to defend, indemnify, and hold harmless us, our officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Site or the Content or your breach of this agreement.

Applicable Law in relation to any person, action or thing means the following in relation to that person, action or thing: 
 
(a) any law, rule or regulation of any country (or political sub-division of a country);

NOT-FOR-PROFIT ORGANISATION TERMS AND CONDITION OF USE

(a) Where a potential volunteer provides us with information in relation to a volunteer opportunity Posted by you, we will endeavour to provide that information to you. 
 
(b) The Site may include information posted by not-for-profit organisations (including information posted by you), potential volunteers and other users of the Site. The Site may also include other information of a general nature, links to other websites and information. 
 
(c) While we technically operate the Site we exercise no editorial control over much of the Content on the Site, and in most cases the Content on the Site is provided by other persons, such as potential volunteers and other users of the Site, not-for-profit organisations (including yourself) and other third parties (Third Party Content). 
 
(d) Your correspondence or dealings with any potential volunteers or any other third parties are solely between you and those potential volunteers or third parties. You are responsible for selecting volunteers that are suitable for your organisation and for meeting all legal and other requirements in relation to those volunteers. We make no recommendation regarding the suitability of any volunteer. You agree that we will not be liable or responsible for any loss or damage of any sort incurred as the result of your dealings with volunteers. 
 
(e) We do not monitor or exercise editorial control over Third Party Content, however we reserve the right at our discretion to: 
(i) access or examine any Third Party  Content;
(ii) refuse to provide any Content Posted by a  potential volunteer to you (regardless of  whether that potential volunteer was  responding to a volunteer opportunity Posted  by you); and 
(iii) move, remove or disable access to Third  Party Content which we consider, in our sole  opinion, to breach any Applicable Law or to be  otherwise unacceptable. 
 
3. Registration 
(a) The Site enables not-for-profit organisations to Post volunteer opportunities to the Site for access by potential volunteers. You will be required to register with us in order to Post volunteer opportunities to the Site. When you register:
(i) you must provide accurate, complete and  updated registration information;
(ii) you must safeguard any user name and  password which is provided to you; 
(iii) you authorise us to assume that any  person using the Site with your user name  and password is either you or is authorised to  act for you; and 
(iv)  you may cancel such registration at any  time by notifying us.

(b) You acknowledge and agree that we are under no obligation to accept any application for registration by you or any other person, including without limitation if you fail to meet our registration criteria or for any other reason. 
 
(c) We may cancel your registration if you do not visit the Site or update any of your Postings on the site for an extended period of time, if you fail to meet our registration criteria as amended from time to time, or if we reasonably believe that you have violated any Applicable Laws, acted inconsistently with the letter or spirit of this agreement, or have violated our rights or those of another party.

MODEL CODE OF PRACTICE FOR ORGANISATIONS INVOLVING VOLUNTEER STAFF
 

In order to enhance the volunteers' experience and comply with legislation and duty of care (insert organisation name) will: 
 
  • interview and employ volunteer staff in accordance with anti discrimination and equal opportunity legislation; 
  • provide volunteer staff with orientation and training; 
  • provide volunteer staff with a healthy and safe workplace; 
  • provide appropriate and adequate insurance coverage for volunteer staff;
  • not place volunteer staff in roles that were previously held by paid staff or have been identified as paid jobs; 
  • differentiate between paid and unpaid roles; 
  • define volunteer roles and develop clear job descriptions
  • provide appropriate levels of support and management for volunteer staff;
  • provide volunteers with a copy of policies pertaining to volunteer staff;
  • ensure volunteers are not required to take up additional work during industrial dispute or paid staff shortage; 
  • provide all staff with information on grievance and disciplinary policies and procedures; 
  • acknowledge the rights of volunteer staff; 
  • ensure that the work of volunteer staff complements but does not undermine the work of paid staff; 
  • offer volunteer staff the opportunity for professional development;
  • reimburse volunteer staff for out of pocket expenses incurred on behalf of the organisation;
  • treat volunteer staff as valuable team members, and advise them of the opportunities to participate in agency decisions; and 
  • acknowledge the contributions of volunteer staff.
